DARREN MERCER WARNED OFF




The Disciplinary Panel of the Jockey Club held an enquiry on 8th July 2004 to consider whether or not Mr Darren C Mercer, a registered owner, had committed breaches of Rule 247 (iii) of the Rules of Racing in respect of his laying with Betfair, a horse owned by himself, namely JOSS NAYLOR (IRE), to lose the Coral Welsh National at Chepstow on 27th December 2003.


The Panel considered evidence from Mr Mercer, who was legally represented, Jonjo O'Neill, the trainer of JOSS NAYLOR (IRE), and Mr David O'Reilly, Legal Counsel of Betfair.

The Panel accepted an admission from Mr Mercer that he was in breach of Rule 247 (iii) in that in five separate telephone conversations with Betfair he had, as the owner of JOSS NAYLOR (IRE), laid the gelding to lose the Coral Welsh National. The Panel was also satisfied that on the occasion of his last two telephone conversations he would already have been aware that the gelding was no longer running in the race and was therefore laying bets to people in the knowledge that it was impossible for him to lose.


The Panel declared Mr Mercer to be made a Disqualified Person for six months from Friday 16th July 2004 until Saturday 15th January 2005 inclusive.




BHB RECRUITMENT AND TRAINING DIRECTOR TO TAKE UP NEW OPPORTUNITY




BHB Recruitment and Training Director Fiona Birt-Llewellin will be leaving BHB for a new opportunity that has arisen in the commercial recruitment industry.


She said today: "The decision to move on was difficult for me to reach. The last year has been extremely rewarding and enjoyable and I am sorry that I will not be able to see through to fruition the work being undertaken to ensure that Racing and Breeding have the well-skilled workforces that they require.


"Much of my time at BHB has been spent working with the Stable and Stud Staff Commission whose report will, I am sure, prove to be as important for Racing and Breeding as any other recent initiative. The Commission's findings and recommendations have my complete support."

BHB Chief Executive Greg Nichols said: "We will be very sad to see Fiona go. She has quickly become a popular and respected executive in the sport and she can look back on a job very well done as Secretary to the Stable and Stud Staff Commission. We hope to appoint her successor as soon as possible."
