RECORD DARLEY JULY CUP FIELD

There will be a record post-war field of 20 for Thursday’s £250,000 Darley Stud July Cup, which boasts an international line-up, featuring challengers from Australia, Hong Kong, Japan, France, Ireland and Britain.


Dual Royal Ascot winner Choisir, who represented the Wallabies 12 months ago, found Oasis Dream too good, but Sydney trainer Tim Martin, whose much-vaunted raider Exceed And Excel joins Sheikh Mohammed’s Darley team after the race, is expecting a huge run from his flying machine.


Exceed And Excel, who won seven of his 11 races Down Under, amassing prize money of $1,282,375, had to miss Royal Ascot when he picked up an infection, but Martin is happy with the way he has been working since and rates him “something special.”

The Hong Kong-trained Cape of Good Hope, who was placed twice at the Royal meeting, behind The Tatling in the King’s Stand and behind Fayr Jag in the Golden Jubilee, might be pushed to reverse form with the latter from his seemingly unfavourable 20 draw, while Frizzante, who finished best of all when in the five-furlong dash (King’s Stand) will definitely be better suited by the extra distance.


Ante-post favourite is Patavellian, who was so impressive when winning the Ladbrokes Bunbury Cup at last year’s July Meeting and, having run so well against The Trader on his seasonal debut in France, he would be a big threat if the forecast rain arrives in time, a remark which also applies to French filly Porlezza, last year’s Haydock Sprint Cup winner Somnus, who ran a cracker on his comeback at Newcastle, and Airwave, who never let herself down on the firm ground at Ascot.


Aidan O’Brien, successful with Stravinsky (1999) and Mozart (2001), runs Antonius Pius who cost $1.5m and threw away the French 2,000 Guineas. The three-year-old colt finished a close third to Azamour in the St James’s Palace Stakes over a mile at Royal Ascot.


However, Antonius Pius is a typical Danzig in that he has speed to burn, and the Ballydoyle team believe that coming back to six furlongs could be the key to a horse whose ability has never been questioned.


But the O’Brien colt is not the only fancied three-year-old as Balmont (Jeremy Noseda), Kheleyf (Saeed bin Suroor) and Moss Vale (Barry Hills) all carry stable confidence.


Gimcrack winner Balmont, who was subsequently awarded the Middle Park Stakes on the disqualification of Three Valleys, is an exciting colt, but Noseda makes no secret of the fact that whatever he achieves on his belated reappearance he will undoubtedly improve on as the season progresses.


Noseda said: “It has been well documented that we had a problem early on, which meant us missing Royal Ascot, but Balmont is 90% where I want him and I feel justified in starting him off in this race. He is mentally there.”

Kheleyf, who disappointed in the Middle Park, looked a different horse on his comeback in the Jersey Stakes at Royal Ascot, sweeping through the field to come from last to first and beat Fokine in impressive fashion, and he will be trying to give both Godolphin and Frankie Dettori their first success in this prestigious sprint.


Simon Crisford, racing manager to the Godolphin team, said: ”Dropping back a furlong will be no problem for Kheleyf - he has such a high cruising speed and looks the right type for the race.”

The Japanese, successful four years ago with Agnes World, were relieved that Seeking the Dia just made the cut, though his compatriot Dorubako was not so lucky, joining American challenger Lydgate, Fire Up The Band, Twilight Blues and Ringmoor Down in being eliminated on ratings.


There is also a full field of 20 on Thursday for the Ladbrokes Bunbury Cup, with Heretic carrying topweight and Play That Tune and Marshman being the two reserves, while a field of 12 line up for the Weatherbys Superlative Stakes, including Godolphin’s Dubawi, a son of the brilliant and much-lamented Dubai Millennium.

Total attendance at this year’s opening day of the July Meeting was 12,815. This is an increase of 28% on the corresponding day last year.

“The sun has shone brightly all day and this race meeting, which has had its prize money increased by over 66% in three years and its race programme dramatically upgraded, continues to go from strength to strength.”

H & K Commissions Bookmakers Handicap

EVEREST PEAKS IN OPENER
What a difference a year makes. Everest, short-headed by Gilded Dancer in the H & K Commissions Bookmakers Handicap 12 months ago, got his nose in front in the July Meeting opener this time around, inching home under Dane O’Neill in a four-way photo-finish with Audience, True Night and Blue Trojan.


The result seemed to indicate that, contrary to majority opinion, low numbers did not have a big advantage, with two coming from each side to fill the first four.


Winning trainer Brian Ellison said: “Everest was unlucky last year, but this has more than made up for that disappointment.


“He got a gash in a front leg earlier in the year, and he got fat and it took us a long time to get rid of his condition.


“But the omens looked good at Carlisle last time. The race did not work out - they went slow and got away from him - but Tom Eaves, who rode him, got off and said ‘he’ll win next time’, and he has been proved right.”

Everest, who is at his element with a fast gallop and an uphill finish, is part-owned by professional punter Henry Rix, who also has a share in third-placed True Night.


Rix, who landed a massive touch on his own horse Lafi in the Wokingham at Royal Ascot last month, said:”Everest was shorter (6-1) than I had hoped, but I snapped up a bit of 7-1.”

Ground is “Beautiful”
- and now is officially good to firm

Kieren Fallon was lavish in his praise of the ground after the first race - if a little succinct.


The champion jockey, having ridden Salagama, simply answered, “beautiful” when asked to describe the quality of the racing surface.


The rest of the jockeys were equally happy with the ground, which was officially declared as good to firm from good immediately after the opening contest.


Richard Hughes, Oh Boy’s jockey, called the ground, “quick” while Jean-Pierre Guillambert claimed it was “plenty quick enough” having ridden Tiber Tiger.


Eddie Ahern, True Night’s rider, was happy to call it, “perfect fast ground.”

ALDERNEY RACE WINS

Alderney Race came late and to fine effect to snatch the totesport Rated Stakes under jockey Steve Drowne.


The Seeking The Gold colt was always travelling handily on the stands’ side before making his move to reverse the form with his William Hill Trophy conqueror Two Step Kid, who finished third.


Successful trainer Roger Charlton said: “When he won his maiden race (at Leicester in May), it was very easy and then at York it was a very fast-run race - they went absolutely flat out.

“He got squeezed coming out of the stalls and then hit the path a bit. He got a bit unbalanced and was then was beaten a length and three quarters in a good race. So we always thought we had a good chance today. He was improving at the right time.


“The course suited him better and he will probably get seven furlongs - he’s a relaxed horse.


“I haven’t really got anything in mind for his next race - I haven’t thought about it, to be honest. It’s a case of one step at a time - we’ll see.”

It’s unlikely the winner wil go for the Stewards Cup at Goodwood with Charlton saying, “I think it’s the wrong sort of track, downhill, fast ground - run him off his legs.”

Drowne hinted there’s more to come from Alderney Race.


The jockey said: “I’m very pleased. He ran in a big race at York - that was his first time in a handicap. It was a very rough race and I got knocked over coming out of the gate.


“He’s very inexperienced, a bit timid and today everything went nicely for him. He’s a horse with a lot of ability and he’s unfinished, will be a nice horse.”

Jeremy Noseda, whose Two Step Kid, the 5-1 favourite, won the race on the far side only to find a couple too smart up the stands’ rails, was delighted with his improving sprinter, who will now take his chance in the Vodafone Stewards’ Cup at Goodwood on July 31.


Two Step Kid had beaten the winner Alderney Race when they met at York last time and, reflecting on the reversal of form, Noseda said: ”This is a stiffer six furlongs than York and, though he looked to have the race won, the last 100 yards just seemed to find him out.


“He is the ideal horse for the Stewards’ Cup, and the easier six will suit him well there. I think he is ready-made for the race - he has the pace to travel and he can pick up.”

Corals and Paddy Power left Two Step Kid unchanged at 12-1 for the traditional midsummer cavalry charge, though Ladbrokes trimmed him two points to 12-1 and Victor Chandler chopped his price to 10-1 from 14-1.


Mick Channon was equally pleased with runner-up Mahmoon, who made a brave attempt to follow up his success here 10 days ago.


Channon said: ”That was a solid performance, but, ultimately, his 8lb penalty has proved a stopper as he has only been beaten three parts of a length. At least he is now stringing a few consistent performances together, and I was pleased with that.”

UNBEATEN JEWEL IN THE SAND

Jewel In The Sand might have a fair way to go before she emulates Attraction, last year’s winner, but she extended her unbeaten sequence to three with a silky-smooth performance to win the Chippenham Lodge Stud Cherry Hinton Stakes.


There was only a head in it at the line as Salsa Brave came flying up the centre of the course, but Jewel In The Sand, the 2-1 favourite, had already done the hard work, and the fact that the first two drew five lengths clear of the rest suggests it was a strong renewal of this Group 2 race.


Bloodstock agent Peter Doyle paid 65,000 euros for Richard Hannon’s filly, and the East Everleigh trainer, relieved that Richard Hughes escaped from a nasty-looking pocket, said: ”She is only a pony and when she went to the front I thought she would win four lengths, but perhaps the ground is faster over this side, because the second gave us a scare.


“I think the first two are good fillies - I liked the second in the paddock - but Jewel In The Sand is not just a whizz, bang two-year-old. I have trained all the family so I know them well, and the fact that she settles so well suggests that a mile will be no problem next season.”

Hannon, who might well run Jewel In The Sand under a penalty in the Princess Margaret Stakes at Ascot’s King George meeting, added: ”She is a lovely filly and you wouldn’t know that she is in the yard. She is a kid’s ride, and we came here very hopeful as she won the Albany Stakes at Royal Ascot despite suffering a nightmare run. I won this race with Lemon Souffle (1993) and she was pretty good.”

Cashmans and Paddy Power quote Jewel In The Sand at 25-1 to emulate Attraction and win next year’s 1,000 Guineas, but Corals offer 33-1, and, despite Hannon’s optimism, Richard Hughes expressed his doubts as to whether she would stay.


He said: ”She has so much speed that you have to worry how far she would stay. She has so many gears and travels, and, though I was hemmed in, I always knew that she had the pace to get me out of trouble. She is a little star.”

Lowther likely for Salsa

Trainer Nick Littmoden admitted to mixed emotions after watching his charge Salsa Brava lay down a big - if ultimately - unsuccessful challenge to Jewel In The Sand, beaten a head.


The two-year-old Almutawakel filly came with a late rattle but the winner had already flown to confirm the form of last month’s Albany Stakes at Royal Ascot.


“She has run a great race and just got going a bit late,” said Littmoden of Salsa Brava. “She charged up the hill and is a very, very good filly”.


“We were right to assume we could finish closer to the winner (Salsa Brava was beaten just under one and a half lengths by Jewel In the Sand in the Albany) - and fair play to the winner. But I would still be looking to take her on again.”

Asked whether jockey Jean-Pierre Guillambert could have got Salsa Brave motoring earlier in the race, Littmoden said: “I’m not going to criticise him - it’s easy from the stands. But I felt we got going a bit late and Richard Hughes slipped inside and we’ve lost sight of (the winner).


“She will be entered for the Lowther - I don’t think we’ll got to Goodwood with her. I think it will be York next.”

Paddy Power quoted Salsa Brava as 33-1 for the 2005 1,000 Guineas.

Attraction-buster
Fanshawe celebrates after Soviet success

Soviet Song ended the unbeaten record of Attraction with a thrilling win in the Group 1 UAE Equestrian and Racing Federation Falmouth Stakes.


The 11-4 chance ran a stormer, held up under Johnny Murtagh, before being produced to beat Attraction by two and a half lengths.


Delighted Newmarket trainer James Fanshawe said: “It’s great - and I’m really pleased for the filly. That was Johnny’s first July course winner. It’s a pity to spoil the Attraction party as she’s achieved an awful lot.


“Soviet Song did it really well today. After Ascot, we really felt we must hold her up today because there would be plenty of people trying to rev up Attraction, sit on her tail so she wouldn’t get away.


“So Johnny said, ‘Right, I’m going to sit in behind and wait’ and it’s paid off. We thought Attraction would go on, but we didn’t want to be the one chasing her; we thought we’d wait that little bit longer.


“We had six runners at Royal Ascot and all were placed with one winner. But I would have swapped them all for her beating Refuse To Bend (in the Queen Anne) but that wasn’t to be.


“The owners, Elite Racing Club, have been great supporters. They bred her and I think are going to keep her at stud. Whether they will keep her in training next year, I’m not sure.


“She wasn’t right last year as I’ve said so many times before. She ran a really good race to be second to Russian Rhythm in 2003 but that floored her. She came back jarred up.


“But this year, she has looked a completely different class despite us managing to get her beat her first two runs. She’s thrived with every run.

“Mark Dennaro, who is an ex-jockey, was with Richard Hannon and Luca Cumani, has done a very good job of riding her. He keeps on telling me she gets better and better.


“Soviet Song is in the Sussex, but I think she likes the sort of track where you can be produced. Also, she’s had quite a few races quite close together, so we might just give her a break to the autumn. I don’t know - we’ll go away and think about it.


Murtagh said: “The race rode great for me. I dropped her in and followed Kieren Fallon (on Favourable Terms) all the way. I thought Kieren had a realistic chance and knew Attraction would be up there making the running.


“I’ve pulled my one out and she has a classy turn of foot. She’s really good and James has been saying all year that she’s training better this year than ever.”

ATTRACTION TEAM “PHILOSOPHIC”

Nothing is forever, and trainer Mark Johnston was philosophic over Attraction’s first defeat in nine races in the Group 1 UAE Equestrian and Racing Falmouth Stakes, in which the odds-on favourite was beaten fair and square by Soviet Song.


Kevin Darley told Johnston that the track beat Attraction in that for the first time in her career the filly, who has bad knees, was asked to quicken running downhill.


However, Johnston, accepting offers of commiseration with a shrug of the shoulders and the declaration “it happens”, saw things differently.


He said: ”Kevin is adamant that they were going fast in front, but at half-way I was worried that he wasn’t going quick enough.


“In her previous races, Attraction has had them all off the bridle early in the race, but this time there were several sitting in behind going equally as well.


“Sure, it is a shame that the winning run is over, but we have been trying to prepare ourselves for this day for a long time now.


“No unbeaten run can go on for ever, but it is disappointing, particularly in view of Attraction’s style of racing. She has done it all so easy and has never had to battle, but Soviet Song attacked us wide and, for whatever reason, she was travelling faster than we were throughout the last two furlongs.


“I don’t subscribe to the view that an older filly has proved too strong for the younger one. It is a weight-for-age race, and if we had run up to our best we would have won - time will tell whether we were below-par.


“As for future plans, I never like to look too far ahead, but I took her out of the Sussex Stakes this morning. The Duke of Roxburghe did not feel that we should even have entered her for Goodwood, taking the view that the undulations would not suit her. But I see no reason to change our plans, and we will go home and re-group before deciding on her next race.”

GREAT DEBUT

The dogs had been barking all over Newmarket that Godolphin’s newcomer Belenus was “something special” for the Strutt & Parker Maiden Stakes, and the reception that greeted Frankie Dettori’s flying dismount after the 13-8 favourite had beaten a classy looking field by a length and a half suggested that the champagne bars were about to do some big business.


Dettori, who was always travelling best on Belenus, said: “He gave me a lovely feel, but what do you expect from a son of Dubai Millennium. He was the best horse that I have ridden and anything that he produces has a great tradition to live up to and is liable to be a smart individual.”

However, Dettori was quick to recommend to Sheikh Mohammed that they take a “softly softly” route to the top.


Dettori said: “We should look for another small race as Belenus is still learning. Run him in a big race too soon and we could lose him, but he is a lovely horse for next year.”

Corals make Belenus a 25-1 chance for next year’s 2,000 Guineas and 33-1 for the Derby - Victor Chandler offer 25-1 about both - but Simon Crisford, racing manager to Godolphin, stressed that they will allow the colt to feel his way.


Crisford, congratulating Sheikh Mohammed and declaring “we have a two-year-old, sir,” explained: “There are no firm plans and we might look at a conditions race before flying too high. He has always been high up in our pecking order and from day one was all quality. We never try them hard at home, but he has shown us all the right signals and is an exciting prospect for next year.”

Belenus’s success more than made up for the earlier disappointment of Godolphin’s Masa, and Crisford said: “She did not perform at Royal Ascot but had done well since so we thought we’d come here. But she is clearly not up to this level.”

Godolphin will be represented in Thursday’s Superlative Stakes by impressive Goodwood winner Dubawi, another son of Dubai Millennium, and Crisford said: “He had to miss Ascot as he suffered a minor niggling problem, but he is fully recovered and we are looking forward to seeing him in action again.”


Barry Hills, trainer of the runner-up Frith, said: “I’m very pleased with the way the horse ran. He couldn’t have run a better race than that.”

Andrew Balding, trainer of the third-placed L’Escapade, said: “I’m very pleased with that. He’s only a May foal and is only going to improve on today, so there’s lots to look forward to.”


RACE SIX

PEERESS COMPLETES THREE-TIMER
- AND IT’S TON-UP FOR FALLON

Kieren Fallon completed a century of winners for the year when Peeress won the racingpost.co.uk Fillies’ Rated Stakes by one and quarter lengths.


The champion jockey was shown to good effect on the Sir Michael Stoute-trained filly as she swallowed up the early pace-setters before scoring comfortably.


Chris Richardson, managing director of winning owner Cheveley Park Stud, said: “She showed a really good turn of foot. She’s an amazing filly, gets going and then when she hits the front she almost stops.


“This was a wonderful advertisment for Pivotal, her sire, whom we stand - and it’s a wonderfully progressive family.


“Kieren said she’s very much on the upgrade and couldn’t have done it better than she has today.


“He rode a great race on her, tucked her in and then produced her nicely.

“She’s obviously a progressively filly. It’s very, very exciting.”

Fallon was similarly upbeat, saying: “This filly just goes from strength to strength.

“I don’t know what her next step is, but she’s going the right way. Hopefully, she will come out of this well and go onto better things.”

Connections were unsure as to future plans.

FOURTH TIME LUCKY FOR ROAD

Long Road ran away with the concluding Robin Parke Memorial Stakes to break his duck at the fourth attempt.


The Diesis colt had finished runner-up on his previous three starts, so trainer Jeremy Noseda was happy his charge had finally lost his maiden tag.


“This was overdue,” said Noseda, after the 11-4 favourite had returned a three-and-a-half length scorer.


“He has always run well and never done anything wrong, so I’m delighted he did the job today.I’ve not thought yet about his next race, I was just hoping he’d win today.


“His owner Mr Belzberg is actually arriving at Edinburgh airport this afternoon before a short stay with his family at Gleneagles. So, I hope he will get the good news when he steps off the plane.”

Jockey Eddie Ahern was delighed with his mount, saying, “He showed a nice turn of foot.”









“IT’S BEAUTIFUL RACING GROUND” - PROSSER

Newmarket’s clerk of the course Michael Prosser hailed “beautiful racing ground” after walking the course this morning.


Prosser is satisfied with conditions ahead of the three-day meeting.


He said: “I walked the course this morning and the ground was good - possibly just on the quicker side of good. We’ve been bathed in sunshine, so the ground may have dried out a little bit more by the time we’re racing.”

Prosser, no doubt, has been pleased with the elements over the past few days with the rain helping his team’s preparations.


He said: “We’ve had plenty of rain or so in the last week or so - not far short of an inch, 22 millimetres to be exact.


“The last time we had to water the track was June 15, during Royal Ascot when it was around 28 degrees centigrade all week.”

Prosser added: “We will be using ground on the far side of the track for all three days. It’s virgin ground that’s not been raced on since last August.”

He also confirmed that no areas of the track have been dolled off ahead of today’s seven-race card, nor are there any plans to do so over the meeting.



CHANDLER PUNTERS FOLLOW PRICEWISE

Victor Chandler have been forced to slash Favourable Terms from 7-1 to 5-1 after the Racing Post’s Pricewise column put up the Selkirk filly for the UAE Equestrian And Racing Federation Falmouth Stakes.


Chandler’s representative Neal Wilkins said: “Pricewise followers have latched on to Favourable Terms. Pricewise had a tremendous June during the big festival meetings and followers are anticipating another favourable result today.”

Wilkins also reported significant money for the James Fanshawe-trained Solar Power in the racingpost.co.uk Fillies’ Rated Stakes. The three-year-old daughter of Marju has been backed in from 7-1 to 11-2. Paddy Power now have Solar Power 11-2 from 7s with Hills making exactly the same price adjustment.


Coral now go 5-1 about Solar Power from sixes with the firm’s spokesman Simon Clare confirming, “a proper gamble”.


Paddy Power have been busy this morning, trimming several runners.


In the opening race, the H&K Commissions Bookmakers Handicap Stakes, St Pancras has been trimmed from 8s to 7s while Everest is into 9-2 from 13-2. Ladbrokes now go 9-2 (from 7s) about Everest and Coral are 5 (from 6) about the same horse while Hills quote 9-2 (from 7).

Two Step Kid (13-2 from 7s) and Traytonic (7s from 8s) have been backed with the Paddy Power in the totesport Rated Stakes.


Also with Power, Godolphin’s Masa is now 4-1, having opened 9-2, for success in the Chippenham Lodge Stud Cherry Hinton Stakes.


Soviet Song is now a 5-1 chance (from 11-4) in the Falmouth report Power.

A CODE OF PRACTICE FOR THE BRITISH BLOODSTOCK INDUSTRY WAS PUBLISHED TODAY.


The Code applies to all sales of bloodstock sold privately and at public auction as well as sales of stallion shares and nominations.


The Code, which will take effect from 1st August, is designed to increase the transparency of all bloodstock transactions and by doing so safeguard the interests of all parties. Alleged breaches of the Code will be reported to the Jockey Club and if the Jockey Club is satisfied there has been a breach the individuals concerned could be banned from British racecourses
and other licensed premises. Previously, the Jockey Club had no jurisdiction over the bloodstock industry.


The Code was developed following two meetings held earlier this year chaired by the Jockey Club's Senior Steward, Julian Richmond Watson, and attended by representatives of the owners, trainers, breeders, bloodstock agents and sales companies.


Jockey Club Senior Steward, Julian Richmond-Watson, said today: "The publication of this landmark Code of Practice underlines the British bloodstock industry's commitment to promoting confidence in the integrity of the industry. The initial meeting was called following some negative publicity which reflected poorly on both the bloodstock industry and racing
as a whole, however, the introduction of the Code should be seen as a very positive development.

"The Code promotes full disclosure for all arrangements arising from any bloodstock transaction and should alleviate previously expressed concerns about a lack of transparency. I have been impressed by the willingness of the parties concerned to work together to produce a comprehensive document.


The Jockey Club is happy to endorse the Code and to issue penalties where there is evidence of a breach.


"Although the Code currently only applies to British transactions, I hope that other bloodstock trading countries may follow suit and adopt the same code or something similar."

The bloodstock summit meetings held earlier this year were attended by representatives of the Irish Turf Club. Interest in the progress of the Code has also been expressed by racing authorities in Australia and the Society of International Thoroughbred Auctioneers (SITA) gave their unanimous approval to the Code at their Annual meeting last month.

Notes for Editors:

1. The background to the development of the code is as follows:

a) In March 2003 the Jockey Club introduced to the Rules of Racing a Code of Conduct designed to increase transparency in dealings between trainers and owners.


b) In December 2003 a newspaper reports on a court case which arose from a dispute about the collapse of the sale of Foodbroker Fancy. Although the case was ultimately settled out of court, prior to the settlement the judge publicly expressed his concern about the manner in which the planned sale was conducted.


c) In January 2004 the Jockey Club reaffirmed its position regarding its concern about a lack of transparency in bloodstock transactions andinvited representatives of the bloodstock industry to attend a meeting to discuss the issue.


d) Following a meeting held in April 2004, a working group under the chairmanship of Philip Freedman, Chairman of the TBA, was established and tasked with developing a code of practice for the bloodstock industry. There was a further meeting in May at which the working group reported on the progress of the document.


2. Bloodstock agents are not licensed by the Jockey Club or any other organisation, however, under the Code of Conduct if an agent is found to have committed a breach of the Code he may be banned from British racecourses and other licensed premises.


3. The Code of Practice has been drawn up and published by the following organisations:

The Bloodstock Industry Code of Practice

Introduction

The Code of Practice sets out the principles which apply to all sales of bloodstock and sales of stallion shares and nominations, be they private sales or sales at public auction, ensuring that sales of bloodstock in Britain set and maintain a high standard of integrity and transparency, which will safeguard the interests of vendors, consignors, bloodstock
agents, owners, trainers and the sales companies.


Definitions

* "Agent" means any trainer, consignor, bloodstock agent, racing or stud Manager or other person or entity who represents a Principal in the sale or purchase of bloodstock, stallion shares and nominations, whether the Agent is paid by way of retainer, commission or other forms of remuneration, or has ongoing financial arrangements (for example the payment of managementor training fees), or not.


* "Principal" means a person or entity who appoints an Agent to act as agent on his behalf in the sale or purchase of bloodstock, stallion sharesand nominations as in the definition above.


* For clarification, words importing the masculine gender shall include the feminine.


Code

1. An Agent owes a duty to his Principal to act at all times in accordance with his Principal's best interests.


2. An Agent shall not place himself in a position where personal interests conflict with the duty to his Principal. In particular, an Agent shall not use his position to obtain a secret profit.


3. When an Agent acts as a vendor or part-vendor and sells or intends to sell any horse in which he has an interest to a Principal, or intended Principal, the Agent must disclose to his Principal, before completion, the full extent of that ownership or interest and the benefit derived from that transaction.


4. If an Agent acts for more than one Principal in a transaction (which might be both the vendor and purchaser), the Agent can only do so if he has first disclosed this fact, before completion, to all his Principals, and obtained their consent.


5. An Agent must notify his Principal, wherever possible in advance, when a conflict of interest could arise, such as transactions involving third parties with whom he has a retainer, transactions where he is aware he will benefit from a third party, or transactions concerning horses which he has previously purchased or been involved with.


6. An Agent shall disclose to his Principal and, if required, account to his Principal for any Luck Money paid to him by or on behalf of a vendor. "Luck Money" refers to any financial payment or payment in kind made by or on behalf of a vendor to a Purchaser or his Agent, after the sale of a horse has been concluded.


7. If an Agent receives an offer to purchase a horse he must relay that offer in its entirety to his Principal and respond in accordance with the Principal's instructions.


8. A vendor must not offer any secret profit to any person whom he believes to be an Agent acting for a prospective purchaser.


Enforcement

9. Any alleged breach of the Code of Practice should be reported to the Jockey Club. It is the responsibility of the complainant of an alleged breach to provide evidence to the Jockey Club in support of the allegation. All parties involved will provide their full assistance to the Jockey Club in the respect of any complaint. If the Jockey Club is satisfied there has
been a breach of this Code of Practice it is likely to consider this to be contrary to the integrity, proper conduct or good reputation of horseracing, and the persons involved, whether bound by the Rules of Racing, or not, may be banned from British racecourses and other licensed premises.
