APPEAL AND ENQUIRIES TO BE HELD BY THE DISCIPLINARY PANEL ON THURSDAY NOVEMBER 29

The Disciplinary Panel of the British Horseracing Authority, on 29th
November 2007, will consider an appeal lodged by John Harris, the
trainer of OURS (IRE), placed second in the Book Online At
wolverhampton-racecourse.co.uk Handicap Stakes, against the decision of the Stewards at Wolverhampton on 17th November 2007 to find that the winner, MACHINATE (USA), ridden by Liam Jones had interfered with OURS (IRE), ridden by Stephen Donohoe and that the interference had not improved MACHINATE (USA)'s placing.
In Absence - Dane O'Neill, Sam Hitchcott, Francis Norton
The Disciplinary Panel of the British Horseracing Authority, on 29th
November 2007, will hold an enquiry into the two breathalyser tests each taken by Dane O'Neill, Sam Hitchcott and Francis Norton at Newmarket on 3rd November 2007, which were all found to contain alcohol in a concentration above the threshold level for breath samples under Part 1 of Appendix P to the Rules of Racing, headed "List of Banned Substances and Notifiable Medications".
The lower of Francis Norton's two samples returned a reading 17
micrograms per 100 millilitres in breath, Sam Hitchcott's 20 and Dane
O'Neill's 18 - all within the range of the 'Lower Level' for which a
caution is issued by the Panel.
The Panel for the appeals will be: Christopher Rathcreedan
(Chairman), Charles Warde-Aldam and Mrs C Cavendish.
Alcohol positives are dealt with at two levels: Lower Level is
17-34 micrograms per 100 millilitres of breath and then penalty is a
caution; 35 and upwards (over the drink driving limit) has a range of
28-60 days with an entry point of 40 days.
After almost 4 years of breathalyser testing, only one jockey
has been suspended after testing positive for alcohol.
