The Disciplinary Panel of the HRA will resume the enquiry, which commenced and was adjourned on February 8th 2006, to consider whether or not Jamie Spencer, the rider of MICKMACMAGOOLE (IRE), had committed a breach of Rule 157 or 158, and whether or not Seamus O'Donnell, a licensed trainer in Ireland and trainer of MICKMACMAGOOLE (IRE), had committed a breach of Rule 155 (ii) concerning the running and riding of the gelding in the Watch Football Whilst You Bet On ITVi Banded Stakes at Southwell on 22 November 2005. The matter was referred for further investigation to the Stewards of the Jockey Club under Instruction H19 by the Southwell Stewards following the gelding's run in the Press Red to Bet on ITVi Banded Stakes on 12 December 2005.
The Panel for the enquiry will be: Jeremy Philips (Chairman), Matthew Lohn and Nicky Vigors
The original notice on the adjournment follows. As the hearing has commenced, no additional comment can be made by either party until the completion of the hearing:
"The Enquiry has been adjourned to a date to be fixed. The Disciplinary Panel has asked that additional enquiries be made by both parties to assist them further in considering this matter. On the basis that this Enquiry is already underway, the Panel has asked that until the next directions hearing by this Panel neither party should make any further comment about its subject matter."
4. Rules 157 (Intent to Conceal) and 158 (Failure to Take All Reasonable and Permissible Measures) state: "Where, in the opinion of the Stewards or the Stewards of the Jockey Club, a Rider has intentionally failed to ensure that his horse is run on its merits the Rider shall be deemed in breach of this Rule and guilty of an offence."
Rule 155 (ii) states: "It shall be the duty of the Trainer to give or cause to be given to the Rider of any horse in his care such instructions as are necessary to ensure the horse runs on its merits."
